Article 1 – Legal Information

1.1 Publisher. The Mixingtip.com website is published by Rue du Dentaire, a French simplified joint-stock company (SAS) with a share capital of €5,000, whose registered office is located at 36 allée Hélène Boucher, 59118 Wambrechies, France. It is registered with the Lille Métropole Trade and Companies Register (RCS) under number 948 525 175 (SIRET 948 525 175 00022). Its intra-community VAT number is FR27948525175.

Article 2 – Purpose and Acceptance

2.1 These Website Terms of Use (the "Terms of Use") set out the conditions for accessing and using the Mixingtip.com website by any person visiting it (the "User").

2.2 Use of the website constitutes acceptance of these Terms of Use. When creating an account, the User expressly accepts them.

2.3 Sales of products are governed by the Mixingtip.com General Terms and Conditions of Sale. In the event of a conflict between these Terms of Use and the Terms and Conditions of Sale on a matter relating to an order, the Terms and Conditions of Sale prevail.

Article 3 – Access to the Website

3.1 The website is accessible free of charge, except for internet connection costs, which remain payable by the User.

3.2 The catalogue may be browsed freely. Certain features, in particular ordering and managing personal information, require the creation of a customer account.

3.3 Purchases on the website are reserved for healthcare and dental professionals, as well as institutions and resellers in the sector, under the conditions set out in the Terms and Conditions of Sale. They are prohibited for private individuals.

3.4 The website accepts orders for delivery to European Union countries (excluding France), the United Kingdom and Switzerland. For deliveries in France, Users are invited to visit the Embout.fr website.

Article 4 – Customer Account

4.1 To create an account, the User provides accurate and up-to-date information, in particular their name, establishment, billing and delivery addresses, email address and, where applicable, intra-community VAT number.

4.2 Login credentials are personal and confidential. The User is responsible for keeping them safe and for any use of their account. The User informs Rue du Dentaire without delay of any unauthorised use.

4.3 Rue du Dentaire may request any proof of the User's professional status, in particular a professional registration number, a company registration extract or an intra-community VAT number. It may suspend or delete an account in the event of inaccurate information, use by a private individual or breach of these Terms of Use.

4.4 The User may request the deletion of their account at any time by writing to info@mixingtip.com.

Article 5 – Services Offered

5.1 Mixingtip.com offers the online sale of dental consumables and equipment, reserved for professionals. The website also provides product information and promotional offers.

5.2 Promotions are updated regularly. They are valid for the period indicated, while stocks last and under the conditions set out in the Terms and Conditions of Sale.

5.3 Information published on the website is provided for guidance only. It does not replace the products' instructions for use, the User's professional judgement or the User's own check of the regulations applicable in their country.

Article 6 – User Obligations

The User undertakes to use the website fairly and lawfully. In particular, the User shall not:

• provide false information or impersonate a third party;
• place fraudulent or bad-faith orders;
• introduce viruses or any malicious code;
• attempt to gain unauthorised access to the website's systems or to other Users' accounts.

Article 7 – Prohibition of Scraping and Misuse

7.1 It is strictly prohibited to:

• access the website by automated means (robots, scripts, artificial intelligence tools, crawlers, etc.) to collect information or compare prices in real time;
• extract, store, republish or make extensive use of the website's data and content;
• impair the availability, security or performance of the website through intensive requests or abnormal technical behaviour.

7.2 Text and data mining. In accordance with Article 4 of Directive (EU) 2019/790 and Article L122-5-3 of the French Intellectual Property Code, Rue du Dentaire expressly opts out of any text and data mining of the website's content, including for the training of artificial intelligence systems.

7.3 Sanctions. Any attempt at scraping or unauthorised access may result in suspension of access to the website, civil liability proceedings (unfair competition, free-riding) and criminal prosecution in the event of an attack on an automated data processing system (Articles 323-1 et seq. of the French Criminal Code).

Article 8 – Intellectual Property

All content on the website (texts, photos, visuals, illustrations, graphic design, logos, the Embout.fr and Mixingtip.com trademarks, domain name, database) is the exclusive property of Rue du Dentaire or its partners and is protected by intellectual property law. Any reproduction, representation or extraction, in whole or in part, is prohibited without prior written authorisation, including by a reseller.

Article 9 – Hyperlinks

9.1 The website may contain links to third-party websites. Rue du Dentaire has no control over these websites and is not responsible for their content.

9.2 Creating a link to the Mixingtip.com website is permitted, provided that it does not harm the image of Rue du Dentaire and does not reproduce its content. Rue du Dentaire may request the removal of any link.

Article 10 – Personal Data and Cookies

10.1 Rue du Dentaire processes Users' personal data, as data controller, in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act (loi Informatique et Libertés).

10.2 Data collected. Last name, first name, establishment, email address, telephone number, intra-community VAT number, billing and delivery addresses, purchase history and browsing data.

10.3 Purposes. Account and order management, customer service, sending commercial offers to professionals, statistics and website improvement.

10.4 Rights. The User has the right of access, rectification, erasure, restriction, objection and data portability. These rights may be exercised by writing to info@mixingtip.com. The User may lodge a complaint with the CNIL (French data protection authority) or with the data protection authority of their country.

10.5 Cookies. The website uses cookies necessary for its operation, as well as audience measurement cookies (Google Analytics) and advertising cookies. Non-essential cookies are only placed with the User's consent, obtained via the cookie banner. The User may change their choices at any time.

10.6 Details of the processing, retention periods and cookies are set out in the website's Privacy Policy.

Article 11 – Liability

11.1 Rue du Dentaire makes every effort to ensure continuous access to the website, but cannot guarantee it. It is not liable for any interruption due to maintenance, updates, technical problems, third-party actions or force majeure.

11.2 Rue du Dentaire takes care to ensure the accuracy of the information published, but cannot rule out errors or omissions. It may correct them at any time.

11.3 The User is responsible for their own IT equipment and for protecting their data against viruses and intrusions.

Article 12 – Changes to the Terms of Use

Rue du Dentaire may amend these Terms of Use at any time. The applicable version is the one online at the time the website is used.

Article 13 – Language

These Terms of Use are drafted in French and translated into English and Dutch for information purposes. In the event of any discrepancy or dispute, only the French version shall prevail.

Article 14 – Governing Law and Jurisdiction

These Terms of Use are governed by French law. In the event of a dispute, and failing an amicable solution, the courts within the jurisdiction of Lille (France) shall have exclusive jurisdiction.
